A.   Mehr Arbeit möglich durch weniger Kündigungsschutz, weniger Mitbestimmung?


Löschen von fast allen Abschnitten dieses vorher langen Textes erfolgte vor einigen Jahren. Es handelt sich um Gesichtspunkte, die sehr durch die allgemeinen Rahmenbedingungen in ihrem jeweiligen Status und durch die mehrheitlichen Wertordnungen bestimmt sind. Immerhin sind Aussagen hierzu wichtig, aber kaum freizuhalten vom Einfließen von persönlichen Meinungen.

Diese beiden Themenkreise sind emotional belastet, weil die Gewerkschaftsfunktionäre nach deutscher Rechtslage einen wesentlichen Teil ihrer Funktion und ihrer daraus resultierenden Macht hieraus ableiten. Dies ist sicherlich den Gewerkschaften nicht vorwerfbar; denn die maßgebliche Politik des Landes wünscht es so.

Kritiker wenden ein, die Gewerkschaften könnten sich stattdessen damit abfinden, dass die Koalitionsfreiheit des Grundgesetzes im wesentlichen geschaffen wurde im Hinblick auf die soziale Funktion der Verteidigung legitimer Arbeitnehmerrechte.

Gewerkschaften haben jedenfalls nützliche Funktionen. Die Frage der eventuellen Eingrenzung von Aktivitäten erfordert deshalb komplexe Antworten.

Die historische Erfahrung ist, dass jedenfalls bei einfachen ausführenden Arbeiten eine wesentliche Gefahr von Missständen zuungunsten der Arbeitnehmer besteht. Denn die Arbeitnehmer haben im Fall von hoher Arbeitslosigkeit für einfache Arbeiten kaum Alternativen.

Für eine eigene Verteidigung der Interessen mangelt es den Arbeitnehmern im nicht-organisierten Status am theoretischem Wissen, an Sprechern und an ausübbaren Machtpositionen. Eine kollektive Vertretung kann erfahrungsgemäß die oft zu beobachtende Missstandsbildung schon in den Anfängen hemmen.
